Acceptance of Terms

Welcome to Leaf Enthusiasts. These Terms of Service (the “Terms”) govern your access to and use of the Leaf Enthusiasts website at https://leafenthusiasts.com (the “Site”) and any related mobile or software applications (collectively, the “Leaf Enthusiasts Platform”), including any future websites, services, or offerings that link to these Terms (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and enter into a legally binding agreement with Leaf Enthusiasts (“Leaf Enthusiasts,” “we,” or “us”). If you do not accept these Terms, you may not use the Services. Your use of the Services is at your own risk, including exposure to content that may be objectionable or inappropriate.

Definitions

• User: You, as a user of the Services.
• Content: All data, information, and materials available on the Services.
• User Content: Content that you upload or transmit through the Services.
• Leaf Enthusiasts Content: Content created by Leaf Enthusiasts, including designs, software, and databases.
• Third-Party Content: Content provided by parties other than Leaf Enthusiasts or its Users.

Eligibility

• You must be an adult to use the Services.
• You represent that your use complies with all applicable laws in your jurisdiction.

Tobacco Disclaimer

The Leaf Enthusiasts Platform is intended for adults and is provided for informational and entertainment purposes. We do not sell tobacco products. Content on the platform may be user-generated and does not necessarily reflect the views of Leaf Enthusiasts. Users are solely responsible for complying with applicable laws and regulations in their jurisdiction.

Changes to the Terms

We may modify these Terms at any time. Material changes will be posted on the Site or otherwise communicated to you. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

Provision of Services

• Service Evolution: Features and content may change, suspend, or discontinue at any time.
• Updates: Updates or upgrades may be required to continue using the Services; failure to install them may limit functionality.

Account Creation and Use

• Registration: Information must be accurate and updated as necessary.
• Security: You are responsible for safeguarding your credentials.
• Communications: You consent to receive service-related messages.

Acceptable Use Policy

You agree not to post, upload, transmit, or otherwise make available any Content or engage in any activity that:

• Is unlawful, harmful, harassing, defamatory, obscene, hateful, or discriminatory.
• Violates another's intellectual-property or privacy rights.
• Constitutes spam, automated scraping, or unauthorized data extraction.
• Impersonates another person or misrepresents affiliation.
• Interferes with or disrupts the Services or servers.
• Attempts to facilitate the sale of regulated products through the platform (including listing items for sale, "DM to buy," or directing users to complete purchases).

We may remove content or suspend accounts that violate this policy.

Prohibition on Private Sales and Solicitation

Leaf Enthusiasts is a community platform for cigar enthusiasts to share reviews, experiences, and information. The private sale, solicitation, or advertising of tobacco products is strictly prohibited. You may not use the Services to:

• Offer to sell, trade, or give away tobacco products to other users.
• Solicit the purchase of tobacco products from other users.
• Advertise or promote external websites, businesses, or individuals selling tobacco products (e.g., "get cheap cigars at xyz.com" or "email me for great deals").
• Direct users to contact you privately (via email, direct message, or any other channel) for the purpose of tobacco sales or transactions.
• Post discount codes, referral links, or promotional content for tobacco retailers without authorization.

Violations of this policy may result in immediate removal of content and/or termination of your account.

Content Moderation and Account Actions

Leaf Enthusiasts reserves the right, at our sole and absolute discretion, to:

• Remove, edit, or refuse to display any User Content for any reason or no reason.
• Suspend, restrict, or permanently terminate any user account at any time, with or without notice, for any reason or no reason.
• Take any action we deem necessary to protect the integrity, safety, or reputation of the Services and our community.

We are under no obligation to provide explanations for moderation decisions or account actions. You acknowledge that Leaf Enthusiasts shall not be liable to you or any third party for any such actions.

User Content

• License: You grant Leaf Enthusiasts a worldwide, perpetual, royalty-free license to use, display, and adapt your User Content for purposes related to the Services.
• Responsibility: You are solely responsible for your User Content and represent that it is lawful and that you have the necessary rights to post it.
• Removal and Moderation: We may remove content or restrict accounts to enforce these Terms or comply with legal obligations. Users may report content or accounts they believe violate these Terms.

Third-Party Content and Links

The Services may display or link to content provided by third parties. We do not control or endorse such content and are not responsible for its accuracy, legality, or safety. Accessing third-party sites is at your own risk.

Intellectual Property

Leaf Enthusiasts owns all intellectual-property rights in the Services, including software, designs, databases, trademarks, and logos. We grant you a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial purposes. No other rights are granted.

Feedback and Suggestions

If you submit ideas or suggestions (“Feedback”), you grant Leaf Enthusiasts a worldwide, perpetual, royalty-free license to use and exploit the Feedback without restriction or compensation to you.

Subscriptions and Fees

We reserve the right to introduce or modify subscription plans or other fees. Any paid features will be clearly disclosed prior to purchase. If required, we will provide notice of material pricing changes.

Advertising and Promotions

The Services do not currently display third-party advertising. If we introduce advertising or promotional material in the future, we will update these Terms and any applicable disclosures.

Hosting and Data Storage

Our Services are hosted on Vercel and use Supabase for backend services and data storage. By using the Services, you understand that your data may be processed by these providers, which may operate servers outside your jurisdiction. See our Privacy Policy for details.

Availability and Reliability

While we strive to keep the Services available and reliable, we do not guarantee uninterrupted or error-free operation. Maintenance, updates, and third-party outages may affect availability.

Mobile / Carrier Charges

Accessing the Services through a mobile network may incur data charges from your carrier. You are solely responsible for such costs.

Copyright Notice & Takedown

If you believe your copyrighted work is being infringed, please email support@leafenthusiasts.com with sufficient detail to locate the material. We will respond in accordance with the U.S. Digital Millennium Copyright Act.

Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available” without warranties. Leaf Enthusiasts is not liable for indirect, incidental, or consequential damages arising from your use of the Services.

Indemnification

You agree to indemnify and hold harmless Leaf Enthusiasts and its affiliates from claims, losses, or liabilities arising out of your use of the Services or violation of these Terms.

Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. Upon termination, your User Content may be deleted.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction there.

Waiver and Time Limit on Claims

Any claim relating to the Services must be filed within one (1) year after the event giving rise to the claim. Failure to enforce a provision is not a waiver of our right to do so later.

Assignment

Leaf Enthusiasts may assign these Terms, in whole or in part, at any time. You may not assign or transfer your rights under these Terms without our prior written consent.

Notices & Electronic Communications

You agree that we may provide notices to you electronically via email or in-app notifications. Such notices are deemed received within 48 hours.

Survival

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, assignment, and survival will survive termination of these Terms.

Entire Agreement & Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Leaf Enthusiasts. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
